Welcome to Vietnam Kiteboarding School (“VKS”, “we”, “us”, “our”). By submitting a booking request, paying a deposit, or using our lessons, equipment rental, or other services, you (“customer”, “you”) agree to the following Terms and Conditions.

1. Bookings and Payment

  • All bookings are requests and are confirmed once VKS has reviewed the details and accepted the deposit payment.
  • A deposit of 10% of the total lesson/package price is required to secure a booking. The remaining balance (90%) is payable locally in cash or by card before or on the first day of your course, unless otherwise agreed in writing.
  • Prices are quoted in USD and are per person unless stated otherwise. Prices may change without notice for bookings not yet confirmed with a deposit.
  • It is your responsibility to provide accurate contact information, arrival/departure dates, and riding level when booking, so we can prepare the right lesson plan and equipment.

2. Cancellation and Rescheduling

  • Cancellations made more than 14 days before the lesson start date: deposit is fully refundable.
  • Cancellations made within 14 days of the lesson start date: the deposit is non-refundable but may be credited towards a future booking within 12 months, at VKS’s discretion.
  • VKS reserves the right to reschedule or shorten lessons due to unsafe wind, weather, tide, or sea conditions, for the safety of the customer and instructors. In this case we will offer alternative dates/times where possible; no cash refund is given for time lost to weather unless VKS is unable to offer any alternative during your stay.
  • No-shows without prior notice are not entitled to a refund or credit.

3. Assumption of Risk and Liability Waiver

  • Kitesurfing, windsurfing, surfing, and other water sports offered by VKS are physically demanding activities that carry an inherent risk of injury, including serious injury, or in rare cases death, even when proper equipment and instruction are used.
  • By booking a lesson or rental, you confirm that you are physically fit and medically able to participate, and you accept full responsibility for disclosing any medical condition, injury, or limitation that could affect your safety or that of others before the activity begins.
  • You agree to follow all safety instructions given by VKS instructors and staff, and to only use equipment in the manner and area instructed.
  • To the fullest extent permitted by law, VKS, its instructors, staff, and partners are not liable for personal injury, loss, or damage to property arising from participation in lessons or use of rental equipment, except where such injury, loss, or damage is caused by the proven gross negligence or willful misconduct of VKS.
  • We strongly recommend that all customers arrange their own travel/health/sports insurance covering water sports activities before arrival, as VKS does not provide this.

4. Minors

  • Customers under 18 years old must have the booking made and the waiver countersigned by a parent or legal guardian, who must accompany or be reachable during the lesson.

5. Equipment Rental

  • Rental equipment must be returned in the condition it was provided, normal wear and tear excepted. The customer is responsible for the replacement cost of any equipment lost or damaged beyond normal wear and tear while in their care.

6. Photos and Media

  • VKS may take photos or videos during lessons for training/safety review and may also use them for promotional purposes (website, social media) unless the customer opts out in writing before the session.

7. Changes to These Terms

  • VKS may update these Terms and Conditions from time to time. The version published on our website at the time of your booking applies to that booking.

8. Governing Law

  • These Terms are governed by the laws of Vietnam. Any dispute will first be attempted to be resolved amicably between the customer and VKS.
